Any employee covered under the rules of the United States Department of Transportation guidelines 49 CFR Part 40 may be subject to drug and alcohol screens for a variety of reasons including pre-employment testing, reasonable suspicion testing, pre-access testing, post-accident testing, and random testing. Any employee testing positive for alcohol or a controlled substance must seek an evaluation by a qualified SAP.
SAP Process
The SAP evaluation consists of a verbal interview and other standardized assessments to determine if the employee has a substance abuse or dependence problem and if so, what type of treatment or other services may be appropriate to address the problem. DOTregulations require a minimum recommendation for some level of substance abuse education or treatment for each case. At the time of the first interview, an appointment is set for a follow-up evaluation.

The SAP evaluator makes treatment and/or education recommendations to the employee and employer and follows the employee through the time the employee is ready to return to work. A second evaluation is performed prior to the employee’s returning to work to determine if they have completed the requirements of the initial evaluation. A Notice of Compliance or a Notice of Noncompliance is then sent to the employer. Notices of Compliance include a schedule for any required follow-up drug testing. Employees are required to complete the entire SAP evaluation process with their initial SAP evaluator.
Information for Employers Making Referrals
Employers are required by law to provide employees or prospective employees with the contact information of a SAP evaluator. To refer an employee or prospective employee to us, we will need the following information from you:
- Your name, title, company name, address, phone number.
- Employee or prospective employee’s name, phone number, date of birth, and social security number.
- Your company’s DOT modality (FMCSA, FRA, FTA, FAA, RSPA, USCG).
- Testing violation type and date of violation.
- Current employment status of employee.
- Name of the Designated Employee Representative (DER) who will receive the evaluation report.
- Whether the employer or employee will be responsible for payment.
- Employee payments are due at the time of evaluation or can be paid in advance by the employer.
Non-DOT SAP Evaluations
Other people who may seek a SAP Evaluation include individuals wanting to fulfill state Department of Motor Vehicles or court requirements for DUI/DWI violations or those individuals who are complying with the drug-free workplace programs of companies whose employees are not subject to DOT regulations. Employers who have drug-free workplace policies may require an employee who has failed or refused a drug or alcohol test to be seen by a DOT-qualified SAP. While they cannot force the employee to comply with the process, if the employee does not do so the employer can legally deny the employee’s return to work.
